\n“your”) and Airnetic LLC (“Airnetic LLC”, “we”, “us” or “our”). If you are
\nentering into this Policy on behalf of a business or other legal entity, you
\nrepresent that you have the authority to bind such entity to this Policy, in
\nwhich case the terms “User”, “you” or “your” shall refer to such entity. If you
\ndo not have such authority, or if you do not agree with the terms of this
\nPolicy, you must not accept this Policy and may not access and use the
\nMobile Application and Services. By accessing and using the Mobile
\nApplication and Services, you acknowledge that you have read, understood,
\nand agree to be bound by the terms of this Policy. This Policy does not
\napply to the practices of companies that we do not own or control, or to

Collection of personal information
\nYou can access and use the Mobile Application and Services without telling
\nus who you are or revealing any information by which someone could
\nidentify you as a specific, identifiable individual. If, however, you wish to use
\nsome of the features offered in the Mobile Application, you may be asked to
\nprovide certain Personal Information (for example, your name and e-mail
\naddress).
\nWe receive and store any information you knowingly provide to us when you
\ncreate an account, publish content, or fill any forms in the Mobile
\nApplication. When required, this information may include the following:
\nAccount details (such as user name, unique user ID, password, etc)
\nContact information (such as email address, phone number, etc)
\nBasic personal information (such as name, country of residence, etc)
\nYou can choose not to provide us with your Personal Information, but then
\nyou may not be able to take advantage of some of the features in the Mobile
\nApplication. Users who are uncertain about what information is mandatory
\nare welcome to contact us.<\/p>\n\n
\nPrivacy of children
\nWe do not knowingly collect any Personal Information from children under
\nthe age of 18. If you are under the age of 18, please do not submit any
\nPersonal Information through the Mobile Application and Services. If you
\nhave reason to believe that a child under the age of 18 has provided
\nPersonal Information to us through the Mobile Application and Services,
\nplease contact us to request that we delete that child’s Personal
\nInformation from our Services.
\nWe encourage parents and legal guardians to monitor their children’s
\nInternet usage and to help enforce this Policy by instructing their children
\nnever to provide Personal Information through the Mobile Application and
\nServices without their permission. We also ask that all parents and legal
\nguardians overseeing the care of children take the necessary precautions to
\nensure that their children are instructed to never give out Personal
\nInformation when online without their permission.<\/p>\n\n
Use and processing of collected information
\nWe act as a data controller and a data processor when handling Personal
\nInformation, unless we have entered into a data processing agreement with
\nyou in which case you would be the data controller and we would be the
\ndata processor.
\nOur role may also differ depending on the specific situation involving
\nPersonal Information. We act in the capacity of a data controller when we
\nask you to submit your Personal Information that is necessary to ensure
\nyour access and use of the Mobile Application and Services. In such
\ninstances, we are a data controller because we determine the purposes and
\nmeans of the processing of Personal Information.
\nWe act in the capacity of a data processor in situations when you submit
\nPersonal Information through the Mobile Application and Services. We do
\nnot own, control, or make decisions about the submitted Personal
\nInformation, and such Personal Information is processed only in<\/p>\n\n
\naccordance with your instructions. In such instances, the User providing
\nPersonal Information acts as a data controller.
\nIn order to make the Mobile Application and Services available to you, or to
\nmeet a legal obligation, we may need to collect and use certain Personal
\nInformation. If you do not provide the information that we request, we may
\nnot be able to provide you with the requested products or services. Any of
\nthe information we collect from you may be used for the following
\npurposes:
\nCreate and manage user accounts
\nSend administrative information
\nSend product and service updates
\nRespond to inquiries and offer support
\nImprove user experience
\nEnforce terms and conditions and policies
\nProtect from abuse and malicious users
\nRun and operate the Mobile Application and Services
\nProcessing your Personal Information depends on how you interact with the
\nMobile Application and Services, where you are located in the world and if
\none of the following applies: (i) you have given your consent for one or more
\nspecific purposes; this, however, does not apply, whenever the processing of
\nPersonal Information is subject to California Consumer Privacy Act; (ii)
\nprovision of information is necessary for the performance of this Policy with
\nyou and\/or for any pre-contractual obligations thereof; (iii) processing is
\nnecessary for compliance with a legal obligation to which you are subject;
\n(iv) processing is related to a task that is carried out in the public interest or
\nin the exercise of official authority vested in us; (v) processing is necessary
\nfor the purposes of the legitimate interests pursued by us or by a third party.
\nNote that under some legislations we may be allowed to process
\ninformation until you object to such processing by opting out, without
\nhaving to rely on consent or any other of the legal bases. In any case, we
\nwill be happy to clarify the specific legal basis that applies to the
\nprocessing, and in particular whether the provision of Personal Information<\/p>\n\n
is a statutory or contractual requirement, or a requirement necessary to
\nenter into a contract.<\/p>\n\n
Managing information
\nYou are able to delete certain Personal Information we have about you. The
\nPersonal Information you can delete may change as the Mobile Application
\nand Services change. When you delete Personal Information, however, we
\nmay maintain a copy of the unrevised Personal Information in our records
\nfor the duration necessary to comply with our obligations to our affiliates
\nand partners, and for the purposes described below.<\/p>\n\n
Disclosure of information
\nTo maintain the highest level of privacy and to protect your Personal
\nInformation to the full extent, we do not share your Personal Information
\nwith anyone and for any reason.<\/p>\n\n
Retention of information
\nWe will retain and use your Personal Information for the period necessary to
\ncomply with our legal obligations, as long as your user account remains
\nactive, to enforce our Policy, resolve disputes, and unless a longer retention
\nperiod is required or permitted by law.
\nWe may use any aggregated data derived from or incorporating your
\nPersonal Information after you update or delete it, but not in a manner that
\nwould identify you personally. Once the retention period expires, Personal
\nInformation shall be deleted. Therefore, the right to access, the right to
\nerasure, the right to rectification, and the right to data portability cannot be
\nenforced after the expiration of the retention period.<\/p>\n\n
California privacy rights
\nConsumers residing in California are afforded certain additional rights with
\nrespect to their Personal Information under the California Consumer Privacy<\/p>\n\n

\nPersonal Information or opt-out of the sale of their Personal Information
\nwhich may include selling, disclosing, or transferring Personal Information
\nto another business or a third party for monetary or other valuable
\nconsideration. To do so, simply contact us. We will not discriminate against

How to exercise your rights

\ncontact details provided in this document. Please note that we may ask you
\nto verify your identity before responding to such requests. Your request
\nmust provide sufficient information that allows us to verify that you are the
\nperson you are claiming to be or that you are the authorized representative
\nof such person. If we receive your request from an authorized
\nrepresentative, we may request evidence that you have provided such an
\nauthorized representative with power of attorney or that the authorized
\nrepresentative otherwise has valid written authority to submit requests on
\nyour behalf.
\nYou must include sufficient details to allow us to properly understand the
\nrequest and respond to it. We cannot respond to your request or provide you
\nwith Personal Information unless we first verify your identity or authority to
\nmake such a request and confirm that the Personal Information relates to

\nWe offer push notifications to which you may voluntarily subscribe at any
\ntime. To make sure push notifications reach the correct devices, we rely on
\na device token unique to your device which is issued by the operating
\nsystem of your device. While it is possible to access a list of device tokens,
\nthey will not reveal your identity, your unique device ID, or your contact
\ninformation to us. We will maintain the information sent via e-mail in
\naccordance with applicable laws and regulations. If, at any time, you wish to
\nstop receiving push notifications, simply adjust your device settings
\naccordingly.<\/p>\n\n

\nThe Mobile Application and Services contain links to other resources that
\nare not owned or controlled by us. Please be aware that we are not
\nresponsible for the privacy practices of such other resources or third
\nparties. We encourage you to be aware when you leave the Mobile

\nevery resource that may collect Personal Information.<\/p>\n\n
Information security
\nWe secure information you provide on computer servers in a controlled,
\nsecure environment, protected from unauthorized access, use, or
\ndisclosure. We maintain reasonable administrative, technical, and physical

\nmodification, and disclosure of Personal Information in our control and
\ncustody. However, no data transmission over the Internet or wireless
\nnetwork can be guaranteed.

\nInternet which are beyond our control; (ii) the security, integrity, and privacy
\nof any and all information and data exchanged between you and the Mobile

Data breach
\nIn the event we become aware that the security of the Mobile Application
\nand Services has been compromised or Users’ Personal Information has
\nbeen disclosed to unrelated third parties as a result of external activity,
\nincluding, but not limited to, security attacks or fraud, we reserve the right to
\ntake reasonably appropriate measures, including, but not limited to,
\ninvestigation and reporting, as well as notification to and cooperation with
\nlaw enforcement authorities. In the event of a data breach, we will make
\nreasonable efforts to notify affected individuals if we believe that there is a
\nreasonable risk of harm to the User as a result of the breach or if notice is
\notherwise required by law. When we do, we will post a notice in the Mobile
\nApplication, send you an email, get in touch with you over the phone.<\/p>\n\n
Changes and amendments
\nWe reserve the right to modify this Policy or its terms related to the Mobile
\nApplication and Services at any time at our discretion. When we do, we will
\nrevise the updated date at the bottom of this page, post a notification in the
\nMobile Application, send you an email to notify you. We may also provide
\nnotice to you in other ways at our discretion, such as through the contact
\ninformation you have provided.
\nAn updated version of this Policy will be effective immediately upon the
\nposting of the revised Policy unless otherwise specified. Your continued use
\nof the Mobile Application and Services after the effective date of the revised
\nPolicy (or such other act specified at that time) will constitute your consent
\nto those changes. However, we will not, without your consent, use your
\nPersonal Information in a manner materially different than what was stated
\nat the time your Personal Information was collected.<\/p>\n\n
